JACKIE CLUB TERMS AND CONDITIONS

Jackie Club is a Benefits Program (hereinafter the Program) through which Jackie Smith (hereinafter the COMPANY) has decided to reward the associated customers who complete actions within the Program and make purchases through jackiesmith.com. For this purpose, it has created the Jackie Club Program that will grant different benefits to the MEMBERS, all according to these REGULATIONS.

MEMBERSHIP

In order to participate in the JACKIE CLUB Program, it is an essential requirement to have an email account, with which the MEMBER may join and become a member of the Program, and whoever participates in this way shall become a MEMBER (hereinafter THE MEMBER).

• To join and participate in JACKIE CLUB, it is necessary to create an account at jackiesmith.com and provide all the information requested by the company, or through the corresponding procedure in case JACKIE SMITH implements another registration mechanism. JACKIE SMITH reserves the right not to incorporate into the Program those customers who do not provide all the required information at the time of application.
• By accepting these REGULATIONS, the client becomes a MEMBER, accepting the terms and conditions set forth herein.
• The information collected by the COMPANY to register the MEMBER in the JACKIE CLUB Program may be processed in order to provide the MEMBER with proposals, offers and promotions resulting from commercial alliances with third parties, or from those in which the COMPANY has a stake.
• By joining the Program, the MEMBER expressly accepts and agrees to the access and processing of the information by the COMPANY in accordance with Jackie Smith's privacy policies.
• For the purposes of becoming a MEMBER, you may only associate one email address per person. The creation of multiple email addresses by the same person will result in immediate disaffiliation from the program, without notice.
• Only individuals may participate in the program. 

POINTS

• These are gift POINTS that the MEMBER will receive for completing different actions within the Program and for purchases* made at jackiesmith.com. The POINTS that the member receives will be accumulated and will be valid for one year from the moment of their accreditation. According to the MEMBERSHIP the MEMBER has at the time of payment, the MEMBER will receive 1, 2 or 3 POINTS for every $1 invested.
  
  
• The POINTS that the MEMBER receives for purchases at www.jackiesmith.com will be equivalent to the Price of the Product at the time of purchase and will NOT include shipping costs, taxes or duties.

*The purchases made in the Digital Market Sale do not accumulate POINTS.

• The MEMBER can redeem his/her POINTS by generating discount coupons from his/her account within the Program only. The discount coupons can be used only once and, in case of not doing so, they will be available for future purchases within the panel of his/her account. Discount coupons cannot be undone once generated. They have no expiration date and can only be used in our online store jackiesmith.com. 

Discount coupons are for the exclusive use of the MEMBER who generated them and can only be used by said MEMBER.

• The POINTS are valid for 1 year from the date they are earned. In the case of new MEMBERS, it will be from the creation of their account.
• The POINTS are of exclusive use for purchases at jackiesmith.com, the amount of the coupons generated corresponds to the same value of the U.S. dollar (USD).
• The accumulation of POINTS within the Program is annual. The MEMBER will be notified 30 days prior to the expiration of the POINTS so that he/she can redeem them. At the end of the period the member's expired POINTS will return to 0 (zero) for the beginning of a new period. The POINTS accumulated after the expiration of this date will remain valid.
• In the event that a customer has made a purchase and is not yet part of the PROGRAM, he/she will have a period of 7 days to become a member and be able to use the POINTS of said purchase.

GENERAL CONDITIONS OF USE

• In order to receive POINTS* in your account, the MEMBER must prove his/her identity before making purchases or completing actions. Purchases made on jackiesmith.com outside the program will not earn POINTS. *The POINTS generated by actions and purchases on the web are automatically credited.
• Any taxes, rights or obligations applicable as a result of a MEMBER in the JACKIE CLUB program will be paid by the MEMBER.
• The COMPANY may deduct or cancel from the accounts of the MEMBERS, any transaction partially or totally credited in error and/or cancelled or reversed, and any transaction accumulated in opposition to the terms of these REGULATIONS, or through the abusive exercise of the rights provided for in these REGULATIONS.
• The COMPANY, as administrator of the JACKIE CLUB Program, reserves the right to manage in the manner it deems most convenient the exact dates for the closing of the period and settlement of accounts.
• The COMPANY as administrator of the JACKIE CLUB Program reserves the right to modify or discontinue the Benefits offered by the same as it deems convenient.
• The COMPANY reserves the right to make any kind of changes in the relationship "purchase amount, accumulation of POINTS, period closings" as defined above, and/or to make any other kind of modification or changes in the terms and conditions of these REGULATIONS, the validity and application of which shall be in accordance with the provisions herein.
• The POINTS accumulated within the Program cannot be redeemed as cash or monetary value, unless otherwise indicated as a form of expenditure as part of the Program.
• In the case of canceled or refunded orders, the POINTS that would have been credited will be removed from the Member's account. In case the Member has made the purchase using a discount coupon, it will be reactivated within 72 hours.
• The program is exclusively intended for end-consumers. The resale of products purchased through this program is prohibited. Failure to comply with this clause will result in the automatic disaffiliation of the offender, who will not be reinstated in the future.
• Orders: Bleecker Street S.A. has created and is the registered owner of the website www.jackiesmith.com with the purpose of offering, exclusively, a service to its own customers. The products for sale on the website www.jackiesmith.com are intended for the End Customer. End Customer of www.jackiesmith.com means the person or persons who do not operate their own business or professional activities and may include, among others, the resale of products purchased on www.jackiesmith.com.

Therefore, www.jackiesmith.com requests users who do not consider themselves to be an End Customer to refrain from attempting to establish business relationships with www.jackiesmith.com and/or from using third party accounts to generate purchase orders relating to products for sale therein.

With respect to the commercial policy described above, www.jackiesmith.com reserves the right not to process orders from persons other than the End Customer and/or any orders that do not conform to such policy.

SCOPE OF THE PROGRAM AND ITS ELEMENTS

The program is effective as of 07/22/2020 for www.jackiesmith.com.

The COMPANY reserves the right to terminate or suspend the Program at any time, and for such purpose shall notify its decision in such sense at least 30 (thirty) calendar days prior to the termination date, by means of a notice made by any mass media or particularly to each member, without giving rise to any claim or compensation to the MEMBERS for any reason whatsoever.

- The COMPANY reserves the right to introduce modifications and changes to these REGULATIONS at any time it deems convenient. In the case of modifications to these REGULATIONS, acceptance shall be perfected by the use of the program after such modifications become effective.

- Any reward, benefit or offer communicated as part of the Jackie Club Program may include specific terms and conditions of the offer, including expiration dates and redemption conditions. The member should read these terms and conditions carefully.

Offers, benefits and rewards are not transferable and are for the exclusive use of the Member receiving them.

TERMINATION FROM THE PROGRAM

The MEMBER may voluntarily request cancellation of the JACKIE CLUB program by expressing his/her intention to customercare@jackiesmith.com.ar.

ACCEPTANCE OF THE RULES

Participation in the program implies acceptance of all the terms and conditions set forth in these REGULATIONS.

BASES Y CONDICIONES JACKIE CLUB

Jackie Club es un Programa de Beneficios (en adelante el Programa) mediante el cual Beyond bowery llc (en adelante la EMPRESA) ha decidido recompensar a los clientes asociados que completen acciones dentro del Programa y efectúen compras a través de jackiesmith.com. Para ello, ha creado el Programa Jackie Club que otorgará distintos beneficios a los SOCIOS, todo ello según el presente REGLAMENTO.

ADHESIÓN

Es requisito indispensable para participar en el Programa JACKIE CLUB tener una cuenta de email, con la que el SOCIO podrá, adherirse y asociarse al Programa, revistiendo quienes así participen el carácter de SOCIO (en adelante EL SOCIO).

• Para adherirse y participar de JACKIE CLUB es necesario crear una cuenta en jackiesmith.com y proveer toda la información solicitada por la empresa, o bien mediante el procedimiento que corresponda en caso de que JACKIE SMITH implemente otro mecanismo de inscripción. JACKIE SMITH se reserva el derecho de no incorporar al Programa a aquellos clientes que no suministren todos los datos requeridos en el momento de la solicitud.
• El cliente al aceptar este REGLAMENTO alcanza la categoría de SOCIO, aceptando las bases y condiciones aquí expuestas.
• La información que la EMPRESA recopile para inscribir al SOCIO al Programa JACKIE CLUB, podrá ser tratada a fin de acercar al SOCIO propuestas, ofertas y promociones, que sean producto de alianzas comerciales con terceras partes, o bien de aquellas en las que la EMPRESA tenga participación.
• El SOCIO, al adherirse al Programa, acepta y acuerda expresamente el acceso y tratamiento de la información por parte de la EMPRESA.
• A efectos de convertirse en SOCIO solo podrá asociar una dirección de correo electrónico por persona. La creación de múltiples direcciones de emails por parte de una misma persona implicará la inmediata desafiliación del programa, sin necesidad de notificación alguna.
• Solo pueden participar del programa personas físicas.

PUNTOS

• Son PUNTOS de regalo que el SOCIO recibirá por completar distintas acciones dentro del Programa y por las compras* realizadas en jackiesmith.com. Los PUNTOS que el socio reciba se acumularán y tendrán validez de un año a partir del momento de su acreditación. De acuerdo a la Membresía que tenga el SOCIO al momento del pago, este recibirá 1, 2 o 3 PUNTOS por cada $1 invertido.

*No acumulan PUNTOS las compras realizadas en el Market Sale Digital.

• El SOCIO, puede canjear sus PUNTOS generando cupones de descuento desde su cuenta dentro del Programa únicamente. Los cupones de descuento pueden ser utilizados solo una vez y en caso de no hacerlo, este quedará disponible para futuras compras dentro del panel de su cuenta. Los cupones de descuento no pueden deshacerse una vez generados. Los mismos, no tienen vencimiento y solo pueden ser utilizados en nuestra tienda online jackiesmith.com.

Los cupones de descuento son de uso exclusivo del SOCIO que los generó y solo pueden ser utilizados por el mismo.

• Los PUNTOS tienen vigencia de 1 año a partir de la obtención de los mismos. Para el caso de nuevos SOCIOS, será a partir de la creación de su cuenta.
• Los PUNTOS son de uso exclusivo para compras en jackiesmith.com, el monto de los cupones generados corresponde a igual valor de la moneda de uso corriente en los Estados Unidos de América.
• La acumulación de PUNTOS dentro del Programa es anual. 30 días previo vencimiento de los PUNTOS se notificará al SOCIO para que pueda redimirlos. Al finalizar el período los PUNTOS vencidos del socio volverán a 0 (cero) para el inicio de un nuevo período. Los PUNTOS acumulados posterior al vencimiento de esta fecha mantendrán su vigencia.
• En el caso que un cliente haya comprado y aun no sea parte del PROGRAMA, contará con un plazo de 7 días para asociarse y poder disponer de los PUNTOS de dicha compra.

CONDICIONES GENERALES DE USO

• Para poder recibir PUNTOS* en su cuenta, el SOCIO deberá acreditar su identidad previamente a efectuar compras o completar acciones. Las compras efectuadas en jackiesmith.com por fuera del programa, no sumaran PUNTOS.

*Los PUNTOS generados por acciones y compras en la web se acreditan automáticamente.

• Cualquier tributo, derecho u obligación aplicable como consecuencia de un SOCIO en el programa JACKIE CLUB estará a cargo del SOCIO.
• La EMPRESA podrá deducir o anular de las cuentas de los SOCIOS, cualquier transacción de forma parcial o total que hubiese sido acreditada por error y/o que fuera cancelada o revertida, y cualquier transacción acumulada en oposición a los términos del presente REGLAMENTO, o mediante el ejercicio abusivo de los derechos que el presente REGLAMENTO contempla.
• La EMPRESA como administrador del Programa JACKIE CLUB se reserva el derecho de administrar de la manera que crea más conveniente las fechas exactas de cierre de período y liquidación de cuentas.
• La EMPRESA como administrador del Programa JACKIE CLUB se reserva el derecho de modificar o discontinuar los Beneficios ofrecidos por el mismo según lo crea conveniente.
• La EMPRESA se reserva el derecho de efectuar cualquier clase de cambios en la relación “monto de compra, acumulación de PUNTOS, cierres de períodos” definidas anteriormente, y/o realizar cualquier otro tipo de modificación o cambios en los términos y condiciones del presente REGLAMENTO, cuya validez y aplicación se regirá de conformidad con lo aquí establecido.
• Los PUNTOS acumulados dentro del Programa no se pueden canjear como efectivo o valor monetario, a menos que se indique lo contrario como una forma de gasto como parte del Programa.
• En el caso de ordenes canceladas o con reembolso, los PUNTOS que se hubiesen acreditado, se eliminarán de la cuenta del Socio. En caso de que el Socio haya realizado la compra utilizando un cupón de descuento el mismo será reactivado dentro de las 72hs.
• El programa esta dirigido exclusivamente a consumidores finales. Se prohíbe la reventa de productos adquiridos a través de este programa. El incumplimiento de la presente clausula dará lugar a la desafiliación automática del infractor, el cual no volverá a ser admitido a futuro.
• Órdenes: Beyond bowery llc. ha creado y es titular registral del sitio web www.jackiesmith.com con el propósito de ofrecer , exclusivamente, un servicio a sus propios clientes. Los productos a la venta en el sitio web www.jackiesmith.com están destinados al Cliente Final. Por Cliente Final de  www.jackiesmith.com se entiende a la persona o personas que no operan sus propias actividades empresariales o profesionales y que pueden incluir, entre otras, la reventa de productos adquiridos en www.jackiesmith.com.
  Por lo tanto, www.jackiesmith.com solicita a los usuarios que no se consideran un Cliente Final que se abstengan de intentar establecer relaciones comerciales con www.jackiesmith.com y/o de utilizar cuentas de terceros para generar órdenes de compra relativas a los productos allí en venta.
  Con respecto a la política comercial descripta anteriormente, www.jackiesmith.com se reserva el derecho de no procesar órdenes de personas que no sean el Cliente Final y/o cualquier otro pedido que no se ajuste a dicha política.

ALCANCE DEL PROGRAMA Y SUS ELEMENTOS

El programa rige desde el 01/04/2022 para www.jackiesmith.com

• La EMPRESA se reserva el derecho de terminar o suspender el Programa en cualquier momento, debiendo a tal efecto notificar su decisión en tal sentido con una antelación no inferior a 30 (treinta) días corridos a la fecha de terminación, mediante aviso realizado por cualquier medio masivo de comunicación o particularmente a cada socio, sin que ello dé lugar a reclamo o indemnización alguna a los SOCIOS por ningún concepto.
• La EMPRESA se reserva el derecho de introducir modificaciones y cambios al presente REGLAMENTO en el momento en que lo crea conveniente. En el caso de modificaciones al presente REGLAMENTO, la aceptación se perfeccionará mediante el uso que se haga del programa con posterioridad a la entrada en vigencia de las mismas.
• Cualquier recompensa, beneficio u oferta comunicada como parte del Programa Jackie Club puede incluir términos y condiciones específicos de la oferta, incluidas fechas de vencimiento y condiciones de canje. El socio deberá leer estos términos y condiciones detenidamente.

Las ofertas, beneficios y recompensas no son transferibles y son del uso exclusivo del Socio que las recibe.

BAJA DEL PROGRAMA

El SOCIO podrá solicitar voluntariamente la baja del programa JACKIE CLUB manifestando su intención a customercare@jackiesmith.com o completando el siguiente formulario acá.

ACEPTACION DE LAS NORMAS

La participación en el programa implica la aceptación de todas las condiciones establecidas en este REGLAMENTO.
